Bar Fights: Can you sue and who is responsible?

Most people view a night out at a bar, restaurant or nightclub as a chance to unwind and enjoy themselves. Unfortunately, many bar patrons have had too much to drink and are now looking to engage in a fight. Whether you are an unwilling participant or the victim of being struck by a chair or beer bottle inadvertently thrown in your direction, you may be entitled to recovery for your injuries. Some injuries common in bar fights include: broken bones, facial lacerations, contusions, traumatic brain injury, and many more. These injuries typically require extensive medical care and have the propensity to cause great pain and suffering for you and your loved ones. Because of this, victims in bar related injuries are typically entitled to substantial damages.

After you are hurt in a bar you may ask, “who is liable for my injuries?” The obvious first answer to this question is the person who assaulted you would be liable. However, often your assailant would possess insufficient funds or personal liability insurance to be able to cover the damages associated with a substantial injury. So typically in these matters, a claim is brought against the bar or establishment in which you were injured in addition to the assailant.

In order to recover from the bar or venue in which you were injured, you must show that the bar was negligent and their negligence led your injuries. Negligence can be proved by showing that the bar failed to uphold its duty to you, the patron. Some duties a bar owes its guest include: the duty to provide adequate security to ensure its customer’s safety, the duty to maintain the premises in a reasonably safe condition for guests, the duty refuse to serve alcohol to intoxicated guests, the duty to ensure security does not use excessive force against you, etc.

If you have been injured at a bar, restaurant, or night club you should contact an attorney immediately. The quicker this process is begun after your injuries, the more likely evidence from witnesses or surveillance footage can be preserved, thus the more likely you are to win your case.
